The Federal Court here Tuesday declared Hashim Jasin of PAS as the rightful winner for the Sanglang state seat in Perlis in the 8 March general election.

The Kangar Election Court on June 18 declared the seat won by Barisan Nasional’s Abdullah Hassan to be vacant following a petition filed by Hashim.

On June 27, Hashim, who is the Kedah PAS commissioner, filed an appeal at the High Court in Kangar to be declared the winner of the Sanglang state constituency.

The appeal, filed through his lawyer Zulmi Sabri, was submitted to High Court senior assistant registrar Khairulshuhadah Yaakob for forwarding to the Federal Court.

Hashim had two weeks from June 17 to appeal against the Election Court decision to declare the Sanglang state seat vacant.

Justice Zainal Adzam Abdul Ghani had found for Hashim but declined to declare him the winner.

Justice Zainal explained that the court had no jurisdiction over the matter as Section 35 (V) of the Election Offences Act 1954 that had given the court such powers had been abolished in 2003.

Hashim lost the seat by 149 votes to Barisan Nasional’s Abdullah in the March 8 general election.

On April 23, Hashim had filed a petition challenging the election results on grounds of errors during the ballot counting process.

The court had left it to the Election Commission to decide on the by-election date.

 

Malaysia Today editor Raja Petra Kamaruddin was arrested Friday afternoon under the Internal Security Act. Three Malaysian newspapers – Sin Chew Daily, The Sun , and Suara Keadilan – were also issued show cause letters by the Home Ministry.

Raja Petra’s arrest comes a day after the Cabinet ordered the Multimedia and Communications Commission (MCMC) to re instate access to all blocked websites, including the controversial Malaysia Today.

Just before my submission of Final Year Dissertation Paper during my uni days, I applied for a few jobs as advertised in local newspaper. Lucky me since after a session of interview, i was succeed but my mum at kampung asked me to spent few weeks in Kampung before i can start a new phase of my life which is working life.

After about a month, then I applied at another advert and managed to get job with one of biggest the construction company in Malaysia and straight away i was assigned in Construction of Optimal Plant Project (MEOG and MOP). My life at that time was terrible and my gut/energy was tested to the limit . I think you know it when you’re involved in Oil and Gas Industry doing Plant construction.

To cut it short, after few years doing construction works in all over Peninsular Malaysia, then I was hired by Petronas till now. My previous company was established in 1966 and Petronas in 1974. From my point of view, if you’re comparing both then what i can say is Petronas is like a Ayam Goreng KFC and my previous just a fresh egg (dan masih penuh dengan taik-taik ayam) in term of everthings. I’m so proud being a Petronas employee and hopefull this loyalty will not faded until the end of my career life. Eventhough rakyat of Malaysia made a thousand of assumption of us and some politician who is big mouth and (mulut takder insurans).

Lastly just to share with you one article published in NST recently, a view of PETRONAS from SHELL Malaysia Chairman. (actually this one almost made me ‘kuar air mata’. There it is..

SAW CHOO BOON: Petronas one of the new ‘Seven Sisters’

Petronas has been described as the role model others would like to follow. What it has achieved in 34 years is astounding and makes it a prime model of the ‘Malaysia Boleh’ spirit WHEN I first came to work some 40 years ago, my father advised me to join an international company. He told me that it would offer a bright career, respect in the community and a comfortable life.

Much has changed 40 years later. While my father was right and the international company I joined did provide me all of the above, the benefits he described are no longer exclusive to international companies.

International companies and their people are in no way special. In my opinion, they all adopt the same ingredients, which they are able to excel at.

It starts with the right leadership — visionary to continually set challenging objectives to drive the company forward, commercially astute to make the right business decisions, willing to take calculated risks, courageous to continually undertake difficult transformations to cope with the changing environment, and motivational to bring out the best in their people to achieve stretched goals.

Of equal importance is adopting and inculcating the right set of values and principles into the culture of the company so that it would always operate with high integrity, ethics and professionalism.

Throughout my career, I have always wished that Malaysian companies could grow into successful global companies.

I have followed the progress of Malaysian companies with interest and I am always delighted to read of their successes, especially when they expand beyond the boundaries of Malaysia on their way to achieve international status.

There are now many Malaysian companies with the necessary ingredients for international success but one particular company stands out. I have had the good fortune to work closely with that company in my career in the oil and gas industry.

Every Malaysian knows of Petronas, but what you may not know is that every one in the oil and gas fraternity internationally knows and, more importantly, thinks very highly of our national oil company.

Petronas is now regarded as one of the new Seven Sisters of the oil and gas industry. The phrase was coined by an angry Enrico Mattei, founder of Italy’s energy group Eni, after World War 2.

The original “Seven Sisters” were: Standard Oil of New Jersey, Royal Dutch Shell, Anglo Persian Oil Company, Standard Oil of New York, Standard Oil of California, Gulf Oil and Texaco.

Mattei needed to secure oil for Italy and was frustrated at being left out of the huge concessions the Seven Sisters controlled in countries such as Saudi Arabia and Iran.

Today, a new group of oil and gas companies has emerged with control over most of the world’s resources. They are aggressive resource holders and seekers. They dictate the rules and have pushed the multinationals, which emerged out of the original seven sisters — ExxonMobil and Chevron of the US and Europe’s BP and Royal Dutch Shell — to the sidelines.

In an informal survey of the industry’s most knowledgeable analysts, bankers, national oil company officials and international oil company executives about the most powerful players in the oil and gas industry today, the Financial Times names the new Seven Sisters as Saudi Aramco (Saudi Arabia), Gazprom (Russia), CNPC (China), NIOC (Iran), Pdvsa (Venezuela), Petrobras (Brazil) and Petronas.

The other six have very large resources but Petronas was chosen because — I quote the Financial Times — “Petronas, Malaysia’s national oil company, has been described as the role model others would like to follow”.

What Petronas has achieved in a mere 34 years is astounding. It must have been daunting for the small group of government secondees, with no experience in the energy industry, to have been given the onerous task of managing the country’s energy resources, developing a national oil and gas business and facing the multinationals that have operated in the country for decades.

They had to be courageous and visionary, qualities that have been perpetuated in the Petronas leadership since then.

Equally daunting was the decision to venture overseas, to countries with environments that even multinationals find very difficult. This happened when Petronas set itself the target of achieving 30 per cent of its earnings from international operations in the early 1990s.

Recognising that Malaysia’s oil and gas reserves are relatively small and would run out one day, Petronas knew that to continue to exist and grow, it had to take its operations overseas.

Petronas’ growth was accelerated as its leaders set out to achieve this target, and achieve it they did. About 40 per cent of its revenue is now generated overseas.

The national oil company now explores in more countries than Shell does. More than one-third of its production now comes from international operations, from over 60 ventures in more than 20 countries, and this will continue to increase into the future.

In the gas business, Petronas owns and operates the largest integrated liquefied natural gas (LNG) complex in the world and is a major supplier to key LNG markets in North East Asia.

Overseas, it is a partner in a LNG plant in Egypt and will be participating in LNG plants in Australia in the near future.

Petronas is the overall market leader in the downstream market in Malaysia, with the largest manufacturing position.

It also operates in several countries overseas, including Thailand, Philippines, China and Vietnam. It has a large presence in the southern African continent and is set to expand further.

Petronas has helped to develop a very proficient local oil and gas service industry capable of operating around the world.

Standards are high, competition for limited energy resources is intense and only the best companies can survive.

Petronas has not only survived but also thrived in the face of these challenges.

So one can understand the pride that the national oil company’s employees feel.

There is a high level of dedication and commitment but, more importantly, there is a very high level of integrity, with the Petronas senior management setting the example.

It operates transparently and above board. It has a very stringent tendering process, equal to that of any international company.

Professionalism is highly valued in Petronas and translates to high skill levels, both technically and commercially, and safe, efficient operations.

There has been no major incident in its years of operations. In terms of reliability, Malaysia LNG has not missed a single cargo delivery in its 25 years of operations, making Petronas the preferred supplier for their customers.

I have worked closely with senior Petronas management. I know many of them would be desired by international oil companies but I also know that it would be hard to entice them away because of their dedication and commitment to the company.

Commercially, they are sharp and tough but fair — an opinion shared by many international companies.

This was echoed by a colleague in another multinational company who told me that negotiating with Petronas was tough going and he expected to be pushed to the limit, but he would prefer dealing with them than many others.

It may strike you as odd that I, a leader of a multinational oil company, would speak so glowingly of a “competitor”.

But I am a Malaysian and I am so proud of the success of our national oil company.

I am also moved to share what I know of the company because I fear that my fellow Malaysians are unaware of the great success Petronas is.

“Malaysia Boleh” is perhaps an overused, much mocked phrase, but the spirit is real, and it is demonstrated by Petronas.

As our 51st anniversary of Merdeka approaches, I think it is time that we recognise our worth and our ability as Malaysians, and give Malaysian companies the credit they deserve.

Are there other Malaysian companies poised to become world-class companies? I believe there are and I will be watching their achievements with pride as a Malaysian.

KESILAPAN MUSLIM DI BULAN RAMADHAN

Pada hemat saya, kita bolehlah mengatakan bahawa objektif atau sasaran yang perlu dicapai oleh Muslim di bulan Ramadhan ini kepada dua yang terutama. Iaitu taqwa dan keampunan. Perihal objektif taqwa telah disebut dengan jelas di dalam ayat 183 dari surah al-Baqarah. Manakala objektif ‘mendapatkan keampunan’ ternyata dari hadith sohih tentang Sayyidatina Aisyah r.a yang bertanya kepada nabi doa yang perlu dibaca tatkala sedar sedang mendapat lailatul qadar. Maka doa ringkas yang diajar oleh Nabi SAW adalah doa meminta keampunan Allah SWT.

Bagaimanapun, kemampuan untuk mendapatkan kesempurnaan pahala ramadhan kerap kali tergugat akibat kekurangan ilmu dan kekurang perihatinan umat Islam kini. Antara yang saya maksudkan adalah :-

1) Makan dan minum dengan bebas setelah batal puasa dengan sengaja (bukan kerana uzur yang diterima Islam). Perlu diketahui bahawa sesiapa yang batal puasanya dengan sengaja tanpa uzur seperti mengeluarkan mani secara sengaja, merokok, makan dan minum. Ia dilarang untuk makan dan minum lagi atau melakukan apa jua perkara yang membatalkan puasa yang lain sepanjang hari itu. (Fiqh as-Siyam, Al-Qaradawi, hlm 112).

Ia dikira denda yang pertama baginya selain kewajiban menggantikannya kemudiannya. Keadaan ini disebut di dalam sebuah hadith, Ertinya : “sesungguhnya sesiapa yang telah makan (batal puasa) hendaklah ia berpuasa baki waktu harinya itu” (Riwayat al-Bukhari)

2) Makan sahur di waktu tengah malam kerana malas bangun di akhir malam. Jelasnya, individu yang melakukan amalan ini terhalang dari mendapat keberkatan dan kelebihan yang ditawarkan oleh Nabi SAW malah bercanggah dengan sunnah baginda. “Sahur” itu sendiri dari sudut bahasanya adalah waktu terakhir di hujung malam. Para Ulama pula menyebut waktunya adalah 1/6 terakhir malam. (Awnul Ma’bud, 6/469). Imam Ibn Hajar menegaskan melewatkan sahur adalah lebih mampu mencapai objektif yang diletakkan oleh Nabi SAW. (Fath al-Bari, 4/138)

3) Bersahur dengan hanya makan & minum sahaja tanpa ibadah lain. Ini satu lagi kesilapan umat Islam kini, waktu tersebut pada hakikatnya adalah antara waktu terbaik untuk beristigfar dan menunaikan solat malam.

Firman Allah ketika memuji orang mukmin ertinya : ” dan ketika waktu-waktu bersahur itu mereka meminta ampun dan beristighfar” (Az-Zariyyat : 18)

يا رسول الله , أي الدعاء أسمع ؟ : قال : جوف الليل الأخير ودبر الصلوات المكتوبة

Ertinya : “Ditanya kepada Nabi (oleh seorang sahabat) : Wahai Rasulullah :” Waktu bilakah doa paling didengari (oleh Allah s.w.t) ; jawab Nabi : Pada hujung malam (waktu sahur) dan selepas solat fardhu” ( Riwayat At-Tirmidzi, no 3494 , Tirmidzi & Al-Qaradhawi : Hadis Hasan ; Lihat Al-Muntaqa , 1/477)

4) Menunaikan solat witir sejurus selepas terawih. Menurut dalil-dalil yang sohih, waktu yang terbaik bagi solat witir adalah penutup segala solat sunat di sesuatu hari itu berdasarkan hadith ertinya “Jadikanlah solat sunat witir sebagai solat kamu yang terakhir dalam satu malam”. (Fath al-Bari, no 936). Sememangnya tidak salah untuk melakukan witir selepas terawih, cuma sekiranya seseorang itu yakin akan kemampuannya untuk bangun bersahur dan boleh melakukan solat sunat selepas itu, maka adalah lebih elok ia melewatkan witirnya di akhir malam.

5) Tidak menunaikan solat ketika berpuasa. Ia adalah satu kesilapan yang maha besar. Memang benar, solat bukanlah syarat sah puasa. Tetapi ia adalah rukun Islam yang menjadi tonggak kepada keislaman sesorang. Justeru, ‘ponteng’ solat dengan sengaja akan menyebabkan pahala puasa seseorang itu menjadi ‘kurus kering’ pastinya.

6) Tidak mengutamakan solat Subuh berjemaah sebagaimana Terawih. Ini jelas suatu kelompongan yang ada dalam masyarakat tatakala berpuasa. Ramai yang lupa dan tidak mengetahui kelebihan besar semua solat fardhu berbanding solat sunat, teruatamnya solat subuh berjemaah yang disebutkan oleh Nabi SAW bagi orang yang mendirikannya secara berjemaah, maka beroleh pahala menghidupkan seluruh malam.

7) Menunaikan solat terawih di masjid dengan niat inginkan meriah. Malanglah mereka kerana setiap amalan di kira dengan niat, jika niat utama seseorang itu ( samada lelaki atau wanita) hadir ke masjid adalah untuk meriah dan bukannya atas dasar keimanan dan mengharap ganjaran redha Allah sebagaimana yang ditetapkan oleh Nabi SAW di dalam hadith riwayat al-Bukhari. Maka, “Sesungguhnya sesuatu amalan itu dikira dengan niat”. (Riwayat al-Bukhari)

8) Bermalasan dan tidak produktif dalam kerja-kerja di siang hari dengan alasan berpuasa. Sedangkan, kerja yang kita lakukan di pejabat dengan niat ibadat pastinya menambahkan lagi pahala. Justeru, umat Islam sewajarnya memperaktifkan produktiviti mereka dan bukan mengurangkannya di Ramadhan ini.

9) Memperbanyakkan tidur di siang hari dengan alasan ia adalah ibadat. Sedangkan Imam As-Sayuti menegaskan bahawa hadith yang menyebut berkenaan tidur orang berpuasa itu ibadat adalah amat lemah. (al-Jami’ as-Soghir ; Faidhul Qadir, Al-Munawi, 6/291)

10) Menganggap waktu imsak sebagai ‘lampu merah’ bagi sahur. Ini adalah kerana waktu imsak sebenarnya tidak lain hanyalah ‘lampu amaran oren’ yang di cadangkan oleh beberapa ulama demi mengingatkan bahawa waktu sahur sudah hampir tamat. Ia bukanlah waktu tamat untuk makan sahur, tetapi waktu amaran sahaja. Lalu, janganlah ada yang memberi alasan lewat bangun dan sudah masuk imsak lalu tidak dapat berpuasa pada hari itu. Waktu yang disepakti ulama merupakan waktu penamat sahur adalah sejurus masuk fajar sadiq (subuh). (As-Siyam, Dr Md ‘Uqlah, hlm 278)

11) Wanita berterawih beramai-ramai di masjid tanpa menjaga aurat. Ini nyata apabila ramai antara wanita walaupun siap bertelekung ke masjid, malangnya kaki dan aurat mereka kerap terdedah da didedahkan berjalan dan naik tangga masjid di hadapan jemaah lelaki. Tatkala itu, fadhilat mereka solat di rumah adalah lebih tinggi dari mendatangkan fitnah buat lelaki ketika di masjid.

12) Memasuki Ramadhan dalam keadaan harta masih dipenuhi dengan harta haram, samada terlibat dengan pinjaman rumah, kad kredit, insuran, pelaburan dan kereta secara riba. Ini sudah tentu akan memberi kesan yang amat nyata kepada kualiti ibadah di bulan Ramadhan, kerana status orang terlibat dengan riba adalah sama dengan berperang dengan Allah dan RasulNya, tanpa azam dan usaha untuk mengubahnya dengan segera di bulan ‘tanpa Syaitan’ ini, bakal menyaksikan potensi besar untuk gagal terus untuk kembali ke pangkal jalan di bulan lain.

Nabi Muhammad menceritakan :-

ذَكَرَ الرَّجُلَ يُطِيلُ السَّفَرَ أَشْعَثَ أَغْبَرَ يَمُدُّ يَدَيْهِ إلى السَّمَاءِ يا رَبِّ يا رَبِّ وَمَطْعَمُهُ حَرَامٌ وَمَشْرَبُهُ حَرَامٌ وَمَلْبَسُهُ حَرَامٌ وَغُذِيَ بِالْحَرَامِ فَأَنَّى يُسْتَجَابُ لِذَلِكَ

Ertinya : menyebut tentang seorang pemuda yang bermusafir dalam perjalanan yang jauh, hal rambutnya kusut masai, mukanya berdebu di mana dia mengangkat tangan ke langit : Wahai Tuhanku…wahai Tuhanku… sedangkan makanannya haram, minumannya haram dan pakaiannya haram..Dan dia dibesarkan dengan memakan makanan haram maka bagaimana Kami mahu mengabulkan doanya. ( Riwayat Muslim, no 1015, 2/703 ; hadis sohih)

Justeru, bagaimana Allah mahu memakbulkan doa orang yang berpuasa sedangkan keretanya haram, rumahnya haram, kad kreditnya haram, insurannya haram, simpanan banknya haram, pendapatannya haram?. Benar, kita perlu bersangka baik dengan Allah, tetapi sangka baik tanpa meloloskan diri dari riba yang haram adalah penipuan kata Imam Hasan Al-Basri.

13) Tidak memperbanyakkan doa tatkala berpuasa dan berbuka. Ini satu lagi jenis kerugian yang kerap dilakukan oleh umat Islam. Nabi SAW telah menyebut :-

ثلاثة لا ترد دعوتهم , الإمام العادل , والصائم حتى يفطر ودعوة المظلوم

Ertinya : “Tiga golongan yang tidak di tolak doa mereka, pemimpin yang adil, individu berpuasa sehingga berbuka dan doa orang yang di zalimi” ( Riwayat At-Tirmizi, 3595, Hasan menurut Tirmizi. Ahmad Syakir : Sohih )

Selain itu, doa menjadi bertambah maqbul tatkala ingin berbuka berdasarkan hadith.

إن للصائم عند فطره دعوة لا ترد

Ertinya : “Sesungguhnya bagi orang berpuasa itu ketika berbuka (atau hampir berbuka) doa yang tidak akan ditolak” ( Riwayat Ibn Majah, no 1753, Al-Busairi : Sanadnya sohih)

Laman berita online KLPOS, melalui undian secara maya telah membuktikan ramai rakyat Malaysia percaya dan yakin tentang Datuk Seri Anwar Ibrahim akan mengambil alih tampuk kepimpinan negara pada 16 September 2008. Sehingga sebentar tadi 9.47 malam, 7 September telah menunjukkan yang 87 peratus percaya tentang pengambil alihan kuasa oleh Pakatan Rakyat yang diketuai oleh Penasihat Parti Keadilan Rakyat (PKR) itu sendiri.

Datuk Seri Anwar ketika ditemubual oleh wartawan Indonesia ketika lawatannya ke sana baru-baru ini juga yakin akan masanya akan tiba untuk beliau menjadi Perdana Menteri Malaysia yang ke-enam. Begitu juga dengan Menteri Besar Selangor yang dipetik berkata 16 September akan menjadi satu sejarah baru Malaysia dengan usaha membawa masuk Ahli Parlimen Barisan Nasional adalah on-track walaupun Ahli Parlimen BN akan menghabiskan duit rakyat dengan membuat lawatan sambil belajar ke luar negara sehingga 16 September.
