Nizar may have lost the legal battle but had won the hearts of people

The Court of Appeal today returned a unanimous decision that Barisan Nasional’s Datuk Zambry Abd Kadir is the rightful Perak menteri besar, ruling that his Pakatan Rakyat rival Datuk Seri Mohammad Nizar Jamaluddinn had ceased to command the majority in the Perak state assembly. The judges also ruled that the Sultan was right in appointing Zambry the MB and that there was no need for a vote of no confidence in the House against Nizar. The three-member Bench comprising Justices Md Raus Shariff, Zainun Ali and Ahmad Maarop delivered judgment after hearing submissions from both parties yesterday.

However, the Court of Appeal decision is not expected to bring an end to the crisis in Perak as the parties can still appeal to the Federal Court. This afternoon, security at the Court of Appeal was tight with police taking extra precautions in allowing people into the courtroom. Nizar’s counsel Sulaiman Abdullah said he would be filing an appeal. Md Raus said he had attempted to write the judgement last night but failed. He assured Suleiman they would have one within a week.

 

Datuk Seri Mohammad Nizar Jamaluddin will be PAS’ candidate for the Bukit Gantang parliamentary by-election, polling of which will be held on April 7. PAS president Datuk Seri Abdul Hadi Awang made the announcement during a PAS rally at Taman Kota Jaya in Simpang. Nizar, 52, is also the deputy PAS commissioner of Perak and state assemblyman for Pasir Panjang.

The Barisan Nasional (BN) has named Bukit Gantang Umno information chief Ismail Saffian, 49, as its candidate for the seat. Nomination is on Sunday.The by-election is necessitated by the death of its Member of Parliament Roslan Shahrom of PAS on Feb 9. In the general election held in March last year, Roslan defeated the BN’s Datuk Seri Abdul Azim Zabidi Roslan by a majority of 1,566 votes while an independent candidate, M. Mogan, secured only 882 votes and lost his deposit.

Meanwhile, Parti Keadilan Rakyat (PKR) vice president Azmin Ali, who was also present, said PKR would ignore the three-month suspension imposed by the Home Ministry today on the party organ, Suara Keadilan

 

“Kalau tanya saya, saya tidak boleh terima seorang yang berjawatan MB (menteri besar) ambil (wakili kawasan) parlimen… kecuali orang yang tidak berjawatan MB,” Menteri Besar Kelantan dipetik berkata di pejabatnya hari ini.

Tambah beliau lagi “Bagi saya, tidak elok kalau MB Perak (Mohammad Nizar) turut bertanding di kawasan lain, sedangkan dia mempunyai kedudukan di kawasan lama. 

“Ini seperti yang dilakukan bekas presiden PAS dahulu, (allahyarham) Datuk Asri Muda, yang bertanding di dua kerusi ketika memegang jawatan menteri besar Kelantan.” 

Itulah bisanya kata-kata Tuan Guru dan Mursyidul Am PAS tidak bersetuju dengan cadangan mereka yang inginkan Datuk Seri Mohammad Nizar Jamaluddin diberi peluang bertanding pada pilihanraya kecil Bukit Gantang nanti. Datuk Nik Abdul Aziz Nik Mat berkata selagi Pakatan Rakyat masih menganggapnya menteri besar Perak, adalah tidak sesuai timbalan pesuruhjaya PAS Perak itu dicalonkan bertanding di kerusi parlimen itu, lapor Bernama.

Apa yang tersirat ialah Tuan Guru menyindir secara halus BN dan juga masih menganggap Pakatan Rakyat masih memegang tampuk pemerintahan Perak.

(2:00pm) Anwar arrives at Mohd Nizar’s house. He is expected to hold a press conference together the menteri besar and Penang CM Lim Guan Eng at 3pm.

(1.32pm) PKR source says that the sultan had asked Mohd Nizar to step down as menteri besar to allow a smooth transistion of power at their brief meeting today but the latter had refused to do so.

(1.30pm) Najib just ended his Perak Umno meeting and left the party’s state headquarters without calling a press conference. It is learnt there was a discussion on who to be appointed as new menteri besar. 

(1.25pm) Najib is still at the Umno meeting. However, it is learnt that he will not be holding a press conference after the meeting. 

(1:10pm) MB Nizar, looking cheerful, just left Istana Kinta and said that Anwar will give a press conference at 3pm at his residence

(11:56am) Najib told reporters that he has informed Sultan Azlan Shah that Barisan has the majority to form the Perak state government. He said the Ruler will announce his decision soon.

(11:55am) Perak speaker V. Sivakumar has just left the High Court after applying to the court to declare the resignation letters of the three assembymen as valid and, therefore, their seats vacant.

(11:50am) PKR de facto leader Datuk Seri Anwar Ibrahim will be at Perak Mentri Besar’s office at 3pm and a mammoth gathering is planned for 7pm at the MB’s residence.

(11:38am) Perak Mentri Besar Nizar told reporters in Bagan Serai that he has just been summoned to Istana Kinta.

(11:34am) Najib has left Istana Kinta with the four assemblymen.

(11:21am) Najib returned to Istana Kinta, this time with four former Pakatan Rakyat elected representatives Jamaluddin Mohd Radzi (Behrang),Mohd Osman Jailu (Changkat Jering), Jelapang Hee Yit Foong (Jelapang) and Datuk Nasaruddin Hashim (Bota) to meet the Sultan of Perak.

(10:35am) Perak Umno state chief Datuk Seri Najib Tun Razak and his deputy Datuk Seri Ahmad Zahid Hamidi leave Istana Kinta. Najib is expected to chair the state liaison committee meeting to discuss the Barisan candidate for the Perak Mentri Besar’s post.

(9:50am) Deputy Prime Minister and Perak Umno chief Datuk Seri Najib Tun Razak and Minister in the Prime Minister’s Department and state Umno deputy chairman Datuk Seri Ahmad Zahid Hamidi (Bagan Datoh MP) enter Istana Kinta to seek Sultan Azlan Shah’s consent for Barisan to form the new Perak government.

(9:00am) Speaker V. Sivakumar told reporters that he will ask the High Court on Thursday to declare as valid the undated letters of resignation by the three Pakatan Rakyat assemblymen – PKR’s Jamaluddin Mohd Radzi (Behrang) and Mohd Osman Jailu (Changkat Jering) and DAP’s Hee Yit Foong (Jelapang) – who resigned from their respective parties to become Independents who have pledged to support Barisan Nasional.
